David Park is a foreign attorney at Yoon & Yang LLC and his main practice areas include corporate law, employment and labor, HR issues, Serious Accident Punishment Act and international transactions (inbound and outbound investments), etc.
After completing his Bachelor of Law degree and Bachelor of Arts degree at the University of Auckland (LL.B./B.A) in New Zealand, Mr. Park worked as an in-house counsel at LG Display. He is currently completing his LL.M. degree at Seoul National University Graduate School of Law.

Representative Matters

[Employment & Labor-General]

  • Advised one of the world’s largest appliance brands on comprehensive labor/HR issues such as the legitimacy of disciplinary action against employees, the legal status of the representative director, mutual termination, restructuring, and occupational accident issues which arose in relation to the death of an employee.
  • Advised one of the world’s largest confectionary companies on comprehensive HR/employment issues such as employee succession, benefits and drafting internal regulations.
  • Advised a European multinational parts manufacturer on workforce reorganization resulting from corporate restructuring.
  • Provided overall HR-related advice to a US multinational software company’s HR Department in relation to the employees of its new Korean subsidiary. More specifically, prepared employment agreement form, Rules of Employment, and benefit and leave policies, etc.
  • Provided general labor law advice and services to a Canadian battery manufacturer with regards to its newly established Korean subsidiary and plant (factory). More specifically, prepared general advice on a rolling basis including on mandatory employee benefits and labor unions, prepared offer letters, employment agreements and Rules of Employment, etc.
  • Provided overall HR/labor-law related advice and services to a spin-off company between the two top-tier global semiconductor companies. More specifically, prepared dual language employment agreements, dual language Rules of Employment, leave policies and benefits policies, and policy regarding employees with disabilities etc.
  • Assisted a multinational US corporation in preparing its Korean subsidiary for a labor audit. More specifically, prepared dual language employment agreement forms, Rules of Employment, a due diligence report on the Korean subsidiary’s overall labor management practices, visa advice in relation to business visits of executives from head office, etc.
  • Assisted one of the world’s largest renewable energy companies on various aspects of employment/labor law in relation to its Korean entities. More specifically, prepared dual language employment agreements, dual language Rules of Employment, leave and severance pay policies, advice on employee dismissal and employee secondment, and employee payroll-related services, etc.

[SAPA]

  • Advised a French multinational company which supplies industrial gases/services on SAPA. More specifically, worked on a consulting/advisory project which involved identifying risk factors in the business and reviewing whether safety and health measures are being taken, and evaluating the safety and health management system and suggesting plans for improvement.
  • Advised a leading global manufacturer of commercial vehicles on SAPA. More specifically, worked closely with senior executives on a consulting/advisory project which involved identifying risk factors in the business and reviewing whether safety and health measures are being taken, and evaluating the safety and health management system and suggesting plans for improvement.
  • Advised one of Korea’s largest construction companies on preparing a draft enforcement decree for the SAPA. More specifically, conducted research for the Client on similar overseas laws, regulations and trends regarding workplace accidents and occupational health and safety.

[Illegal Dispatch]

  • Advised one of the world’s largest automobile manufacturers on a criminal case regarding illegal dispatch of workers. More specifically, assisted the litigation team and worked closely with General Counsel to formulate arguments and strategies.

[Workplace Harassment/Workplace Sexual Harassment]

  • Conducted an investigation on behalf of a French multi-national luxury fashion company with regards to a sexual harassment claim filed by an employee against another employee. More specifically, conducted a full-scale investigation by conducting interviews with all related parties and prepared a final report for the client.
  • Conducted an investigation for a top-tier German multi-national large vehicle manufacturer with regards to a sexual harassment claim filed by an employee against an executive. More specifically, conducted a full-scale investigation by conducting interviews with all related parties, prepared a final report and provided appropriate recommendations to the client.
  • Conducted an investigation on behalf of a Chinese multinational company with regards to multiple workplace harassment claims filed by employees against the CEO of the Korean subsidiary. More specifically, conducted in-person and phone interviews with all relevant parties and prepared a final report for the client based on our findings.
  • Conducted an investigation on behalf of a UK multi-national company with regards to a workplace harassment claim filed by an employee against a senior executive. More specifically, conducted a full-scale investigation by conducting interviews with all related parties and prepared a final report to the client.
  • Assisted a US multi-national company with regards to an investigation on the country manager of its Korean subsidiary. More specifically, conducted a full-scale investigation on alleged claims of sexual harassment, embezzlement of company funds and theft of a competitor’s trade secrets.
  • Assisted a Korean automobile distributor with regards to a sexual harassment within the workplace investigation. More specifically, conducted in-person and phone interviews with all relevant parties and prepared a final report for the client based on our findings and provided appropriate measures.

[Dismissal/Termination Claims]

  • Successfully advised a global automobile parts manufacturer with regards to an unfair dismissal claim filed by an employee to the Korean Labor Relations Commission.
  • Successfully advised a US globally diversified Fortune 500 medical product manufacturer/conglomerate in relation to the dismissal of a senior employee who engaged in embezzlement and occupational breach of duty. More specifically, conducted a detailed investigation and assisted the Client in filing criminal claims and taking disciplinary measures.
  • Advised a global company in relation to a dispute filed before the Korean Labor Relations Commission.
